TERMS AND CONDITIONS FOR 24-HOUR GYM MEMBERSHIP AND AFTER-HOURS ACCESS

1. Introduction

1.1 These Terms and Conditions (Agreement) govern the membership, access, and use of Bloc 24 facilities (Centre), including 24-hour services and after-hours access.
1.2 The Centre is operated by State of Motion Trading Pty Ltd trading as Bloc 24 (Bloc 24), with its registered office at 5 Plaza Parade, Maroochydore QLD 4558.
1.3 By signing this Agreement or using the Centre facilities, you (Member) acknowledge and agree to these Terms and Conditions and all relevant policies implemented by Bloc 24.

2. Definitions

2.1 Access Credentials: Personal access tools including keycards, access codes, and biometric data issued to Members for entry.
2.2 After-Hours Period: Any period that is not a staffed hour will be an After-Hours Period.
2.3 Authorisation of Payment Form means the form that authorises payment and includes the Direct Debit Authority.
2.4 Centre Rules means the centre rules displayed within the Centre and include:
1. (i) body corporate or building rules.
2. (ii) Safety rules
3. (iii) Other terms and conditions or rules as displayed.
2.5 Dangerous Recreational Activity means an activity engaged in for enjoyment, relaxation or leisure that involves a significant degree of risk of physical harm to a person.
2.6 Direct Debit Authority means the Direct Debit Request Authorisation Form.
2.7 Emergency Contact Protocol: The prescribed procedures for contacting emergency services, Bloc 24 representatives, and using emergency equipment during the After-Hours Period.
2.8 Emergency Equipment: Safety equipment including but not limited to first aid kits, Automated External Defibrillators (AEDs), emergency phones, and duress alarms installed at the Centre.
2.9 Extra Services means services other than your Membership.
2.10 Health Questionnaire means the health questionnaire you must undertake at the start of your Membership.
2.11 Gross Negligence: Conduct that demonstrates reckless disregard for the safety or property of others.
2.12 Member: An individual who has completed the registration process, signed this Agreement, and been authorised by Bloc 24 to use the Centre facilities.
2.13 Obvious Risk to a person who suffers harm is a risk that, in the circumstances, would have been obvious to a reasonable person in the position of that person.
2.14 Our Website means www.bloc24.au or such other site used from time to time.
2.15 Premises: The physical location of the Centre at 5 Plaza Parade Maroochydore, QLD 4558.
2.16 Privacy Policy means our privacy policy on Our Website.
2.17 Unauthorised Access: Entry or attempted entry to the Centre by non-Members or through sharing of Access Credentials.

3. Membership Terms

3.1 Eligibility
1. (i) Membership is restricted to individuals aged 18 years and above.
2. (ii) Members may be required to provide government-issued photo identification and proof of age upon registration.
3. (iii) Persons under the age of 18 are not permitted to hold a membership or use the facilities at any time, whether accompanied by an adult or otherwise.
4. (iv) Members warrant they are physically capable of using fitness equipment. Pre-existing medical conditions affecting facility use must be declared in writing.
5. (v) Membership is contingent upon:
  1. (a) Your Membership Application being accepted.
  2. (b) Your completion of the Health Questionnaire to our satisfaction.
  3. (c) Your completion of the Authorisation of Payment Form to our satisfaction
  4. (d) Your agreement to watch our induction video which may include instruction about safety and any other matters we consider relevant to you; and
  5. (e) Your agreement to comply with the Centre Rules.
  6. (f) Your agreement to comply with any lawful directive of our employees or contractors.
3.2 Membership Fees and Payment
1. (i) Membership fees are payable weekly on the same day of the week that you signed your membership.
2. (ii) Current fee schedule:
  1. (a) The current fee schedule is set out on our website and/or as advised to you from time to time.
3. (iii) Late payment fees:
  1. (a) Late payment fees are set out on our website and/or as advised to you from time to time.
  2. (b) Late payment fees apply to payments more than 3 days overdue.
4. (iv) Bloc 24 reserves the right to adjust fees with 14 days' written notice to Members.
5. (v) Declined payments or your actions to state that you will not pay will result in immediate access suspension until payment is processed.
3.3 Continuing Membership
1. (i) Your continuing membership is subject to your ongoing and complete compliance with these Terms.
3.4 Cancellation and Refunds
1. (i) Members may cancel their membership at any time through the Bloc 24 Member Portal. Membership will remain active until the end of the next billing cycle.
2. (ii) No partial refunds will be issued for any unused portion of the membership.
3. (iii) Bloc 24 may terminate membership immediately for:
  1. (a) Breach of this Agreement
  2. (b) Dangerous or disruptive conduct
  3. (c) Non-payment exceeding 7 days
4. (iv) No refund applies where membership is terminated under clause 3.3(c).
5. (v) There is no cooling-off period for memberships.
3.5 Non-Transferability
1. (i) Memberships are non-transferable and cannot be assigned to another person.

4. Your Use of the Centre

4.1 Access to Centre
1. (i) Access to the Centre is conditional upon you having your access pass.
2. (ii) You are not permitted to provide your access card to non-Members.
3. (iii) A fine of $150 applies to you if you allow a non-member to access the Centre outside of the terms in this clause. Further, in such circumstances you agree to indemnify us in relation to any injury sustained by that person and form of damage that person causes to the Centre or those in the Centre.
4. (iv) You acknowledge that it may be necessary for the Centre to restrict the use of any item of equipment for safety or maintenance reasons or otherwise close off part of the Centre from time to time.
5. (v) You will have unlimited access to the Centre 24-hours, 7 days a week, subject to these Terms.
4.2 Your Health
1. (i) You acknowledge that participating in exercise activities will incorporate various degrees of physical exertion and/or physical risk that may result in death or personal injury.
2. (ii) You agree to always be truthful in your disclosure to us about your physical condition including any existing medical conditions. You further agree to advise us of any change to your physical condition or if any medical condition arises.
3. (iii) You agree that this is your ongoing obligation.
4. (iv) If you are unwell or injured, you agree not to use the facilities or participate in activities in the Centre. This is for your health and safety and the health and safety of the other members.
5. (v) If you are feeling unwell or are injured using any equipment or otherwise being involved in any activity in the Centre, you agree to immediately stop any such workout or activity and notify a staff member.
4.3 Extra Services
1. (i) Bloc 24 may offer Extra Services to you as a member that can be purchased separately, and in addition to your Membership fees.
2. (ii) Pricing for these Extra Services is available from Bloc 24 and will change from time to time without notice.
3. (iii) We may charge you the full fee for an Extra Service if you are more than 15 minutes late for an appointment relating to these Extra Services.
4.4 Use of Equipment
1. (i) You agree to:
  1. (a) be careful with weights and other equipment in the Centre.
  2. (b) replace all equipment, including weights, once finished.
  3. (c) not to occupy equipment for more than 20 minutes at a time, so as to allow others to use such equipment.
4.5 Damage to Equipment
1. (i) Members are responsible for any damage to equipment caused by misuse, negligence, or failure to follow instructions.
2. (ii) Bloc 24 may recover the reasonable costs of repair or replacement from the Member.

5. Access and Security

5.1 Hours of Operation
1. (i) The Centre operates 24 hours daily, including public holidays.
5.2 Staffed hours for the Centre will be posted on our website and prominently within the Centre.
5.3 Any period that is not a staffed hour will be an After-Hours Period.
5.4 You acknowledge, that you are aware of the staffed hours and where to find such times from time to time.
5.5 You accept that the notice provided by us as to staffed hours can be provided by social media.
5.6 Access Credentials
1. (i) Personal access tools including phone applications, keycards, access codes, and biometric data issued to Members for entry.
2. (ii) Members must not:
  1. (a) Share or lend Access Credentials
  2. (b) Allow entry to non-Members
  3. (c) Prop open security doors
3. (iii) Breach of 5.2(ii) results in:
  1. (a) Immediate membership termination
  2. (b) $150 security breach fine
  3. (c) Liability for resulting losses or damages
5.7 Lost/Stolen Access Credentials
1. (i) Must be reported immediately to team@bloc24.au
2. (ii) Replacement fee: $70
3. (iii) Reset credentials available within 72 hours
5.8 Emergency Protocols
1. (i) During After-Hours Period, Members must:
  1. (a) For medical emergencies:
    1. A. Call 000 immediately
    2. B. Activate duress alarm if required
    3. C. Follow AED instructions if cardiac emergency
  2. (b) For security incidents:
    1. A. Do not confront intruders
    2. B. Contact police on 000
    3. C. Exit premises safely
    4. D. Report to team@bloc24.au when safe
  3. (c) For equipment/facility issues:
    1. A. Cease using affected equipment
    2. B. Report via team@bloc24.au

6. Safety Equipment and Training

6.1 Emergency Equipment locations: You acknowledge that you have been shown and that the Centre is signed appropriately for you to be aware of the locations of the following:
1. (i) AED
2. (ii) First aid kits
3. (iii) Duress alarms
6.2 Members must complete a Health Questionnaire at the start of their membership and update Bloc 24 on any changes to their physical condition.
6.3 Members must watch an induction video as part of their membership.
6.4 Member Safety Obligations: Members must:
1. (i) Behave properly. You agree that we have absolute discretion as to what behaving properly means.
2. (ii) Be respectful of others.
3. (iii) Wear appropriate workout footwear and dress appropriately, including wearing athletic attire and enclosed shoes.
4. (iv) Use equipment as intended and within capacity.
5. (v) Not exercise under the influence of alcohol/drugs.
6. (vi) Report hazards immediately.
7. (vii) Follow posted safety instructions.
8. (viii) Not occupy equipment for more than 20 minutes at a time.
9. (ix) Carry a charged mobile phone on their person during After-Hours Periods for emergency use.
10. (x) Use a towel on all equipment and wipe down equipment after use.

7. Insurance and Liability

7.1 Bloc 24's Insurance
1. (i) Bloc 24 maintains public liability insurance of $20,000,000 through Berkley Insurance Australia.
7.2 Risk Acknowledgment
1. (i) Members acknowledge:
  1. (a) Exercise carries inherent risks.
  2. (b) Risks increase during After-Hours Period.
  3. (c) Medical clearance is recommended before starting exercise.
  4. (d) The Member acknowledges that during After-Hours Periods the Centre may be completely unstaffed, and Bloc 24 does not provide supervision, monitoring, or real-time response to incidents. The Member accepts that they may be training alone and that emergency response times may be delayed.
7.3 Liability and Indemnity
1. (i) Members use facilities at their own risk.
2. (ii) Bloc 24 is not liable for:
  1. (a) Personal injury or death
  2. (b) Loss/damage to property
  3. (c) Theft of personal belongings
  4. (d) Personal trainers, coaches, and providers of Extra Services operate as independent contractors. Bloc 24 is not responsible or liable for any act, omission, advice, or service provided by contractors.
7.4 Members must indemnify Bloc 24 for any injury or damage caused by a non-member they allow access.
7.5 This clause does not exclude liability under Australian Consumer Law.
7.6 Civil Liability Act 2003 (QLD)
1. (i) You acknowledge that the use of the Centre could be a dangerous recreational activity.
2. (ii) We are not liable in negligence for harm suffered by you or another person as a result of the materialisation of an obvious risk of a dangerous recreational activity engaged in by the person suffering harm.

8. Privacy and Surveillance

8.1 CCTV Operation
1. (i) 24-hour video surveillance operates throughout the Centre.
2. (ii) Access is restricted to authorised personnel.
3. (iii) CCTV footage is recorded but not actively monitored in real time. Bloc 24 does not guarantee immediate response to any incident captured on surveillance.
8.2 Personal Information
1. (i) Collection is limited to necessary information.
2. (ii) Biometric data requires separate consent.
3. (iii) Storage complies with Privacy Act 1988 (Cth).
4. (iv) Members may access their information via team@bloc24.au.
8.3 Camera Use
1. (i) Members are prohibited from using cameras in the Centre to protect the privacy of others.
8.4 Privacy Policy
1. (i) Our Privacy Policy forms part of this agreement.

9. Miscellaneous

9.1 Governing Law
1. (i) This Agreement is governed by the laws of Queensland.
9.2 Severability
1. (i) Invalid terms shall be severed while the remainder continues in force.
9.3 Entire Agreement
1. (i) This document constitutes the complete agreement between parties.
9.4 Notification of Changes
1. (i) Members must notify Bloc 24 of changes to their contact information within 7 days.
9.5 Amendments
1. (i) Bloc 24 reserves the right to change these terms, including fee adjustments, with 14 days' notice. The notice period does not apply to changes to in relation to clauses 4.1(v) and 4.3.
9.6 Electronic Signature
1. (i) This Form may be executed electronically in accordance with the Electronic Transactions Act 1999 (Cth).
9.7 Dispute Resolution
1. (i) Any dispute relating to this Agreement or Membership must first be submitted in writing to Bloc 24 management.
2. (ii) If unresolved, the dispute may be referred to external mediation before any legal proceedings are commenced.

Safety Waiver

Bloc 24 collects, holds, uses, transfers, discloses and otherwise processes personal information. By using our services and our website, you consent to us collecting, maintaining, transferring, using, processing, holding and disclosing your personal information in the manner described in this Privacy Policy.

Personal Information has the meaning given to it in the Privacy Act 1988 (Cth) (the Act). In general terms, it is any information that can be used to personally identify you. This may include your name, address, telephone number, email address, date of birth, and health or fitness information. Your personal information will not be shared, sold, rented or disclosed to others without your express consent. All information collected and recorded will only be used to operate Bloc 24, deliver our services, and comply with obligations under applicable laws and regulations.There are some instances when Bloc 24 may need to provide your Personal Information to third parties — for example, we may be bound by law to provide your details to government bodies or insurance providers, or we may share necessary details with contracted service providers (such as payment processors or booking platforms) to facilitate our services. In these cases, we require that those parties protect your information in line with this policy.
